 "Oaths in Islam: Truthfulness, False Oaths, and Their Consequences"



الَّذِينَ يَنقُضُونَ عَهْدَ اللَّهِ مِن بَعْدِ مِيثَاقِهِ وَيَقْطَعُونَ مَا أَمَرَ اللَّهُ بِهِ أَن يُوصَلَ وَيُفْسِدُونَ فِي الْأَرْضِ ۚ أُولَٰئِكَ هُمُ الْخَاسِرُونَ


Those who break the covenant of Allah after contracting it and sever that which Allah has ordered to be joined and cause corruption on earth, it is those who are the losers.


Surat Al-Baqarah 2:27


 وَٱلَّذِينَ يَنقُضُونَ عَهۡدَ ٱللَّهِ مِنۢ بَعۡدِ مِيثَـٰقِهِۦ وَيَقۡطَعُونَ مَآ أَمَرَ ٱللَّهُ بِهِۦۤ أَن يُوصَلَ وَيُفۡسِدُونَ فِى ٱلۡأَرۡضِ‌ۙ أُوْلَـٰٓٮِٕكَ لَهُمُ ٱللَّعۡنَةُ وَلَهُمۡ سُوٓءُ ٱلدَّارِ 


“And those who break the covenant of Allah after its confirmation and cut asunder that which Allah has ordered to be joined and make mischief in the land; (as for) those, upon them shall be curse and they shall have the evil (issue) of the abode.” 


(Surah Ra’d 13:25)



بَلَىٰ مَنۡ أَوۡفَىٰ بِعَهۡدِهِۦ وَٱتَّقَىٰ فَإِنَّ ٱللَّهَ يُحِبُّ ٱلۡمُتَّقِينَ


Yes, whoever fulfills his pledge and fears Allah much; verily, then Allah loves the Muttaqin (the pious).


 إِنَّ ٱلَّذِينَ يَشۡتَرُونَ بِعَهۡدِ ٱللَّهِ وَأَيۡمَـٰنِہِمۡ ثَمَنً۬ا قَلِيلاً أُوْلَـٰٓٮِٕكَ لَا خَلَـٰقَ لَهُمۡ فِى ٱلۡأَخِرَةِ وَلَا يُڪَلِّمُهُمُ ٱللَّهُ وَلَا يَنظُرُ إِلَيۡہِمۡ يَوۡمَ ٱلۡقِيَـٰمَةِ وَلَا يُزَڪِّيهِمۡ وَلَهُمۡ عَذَابٌ أَلِيمٌ۬ 


Verily, those who purchase a small gain at the cost of Allah's covenant and their oaths, they shall have no portion in the Hereafter (Paradise). Neither will Allah speak to them nor look at them on the Day of Resurrection, nor will He purify them, and they shall have a painful torment.)


(Surah Ali-‘Imrān 3 : 76-77)


 إِنَّ شَرَّ ٱلدَّوَآبِّ عِندَ ٱللَّهِ ٱلَّذِينَ كَفَرُواْ فَهُمۡ لَا يُؤۡمِنُونَ • ٱلَّذِينَ عَـٰهَدتَّ مِنۡہُمۡ ثُمَّ يَنقُضُونَ عَهۡدَهُمۡ فِى ڪُلِّ مَرَّةٍ۬ وَهُمۡ لَا يَتَّقُونَ 


55.Verily, the worst of living creatures before Allah are those who disbelieve, -- so they shall not believe.) (56. They are those with whom you made a covenant, but they break their covenant every time and they do not have Taqwa.)


(Surah al-Anfāl 8:55-56)


 ۚ وَأَوْفُوا بِالْعَهْدِ ۖ إِنَّ الْعَهْدَ كَانَ مَسْئُولًا


“And fulfill the promise, surely (every) promise shall be questioned about.” 


(Surah al- ‘Isrā’, 17:34)


يَا أَيُّهَا الَّذِينَ آمَنُوا أَوْفُوا بِالْعُقُودِ


“O you who believe! Fulfill the obligations.” 


(Surah al-Mā’ida 5:1)


يأَيُّهَا الَّذِينَ ءَامَنُواْ لِمَ تَقُولُونَ مَا لاَ تَفْعَلُونَ

كَبُرَ مَقْتاً عِندَ اللَّهِ أَن تَقُولُواْ مَا لاَ تَفْعَلُونَ


“O you who believe! Why do you say that which you do not do? It is most hateful to Allah that you should say that which you do not do.” 


(Surah as-Saff 61 :2-3)


وَالَّذِينَ هُمْ لِأَمَانَاتِهِمْ وَعَهْدِهِمْ رَاعُونَ


Those who are faithfully true to their Amanat and to their covenants are Ra`un.


(Surah 23. Al-Muminun, Ayaah No: 8)



Narrated/Authority of Abu Huraira


عَنْ أَبِي هُرَيْرَةَ، عَنِ النَّبِيِّ ﷺ قَالَ


«ثَلَاثَةٌ لَا يُكَلِّمُهُمُ اللَّهُ، وَلَا يَنْظُرُ إِلَيْهِمْ، وَلَا يُزَكِّيهِمْ، وَلَهُمْ عَذَابٌ أَلِيمٌ: رَجُلٌ عَلَى فَضْلِ مَاءٍ بِالطَّرِيقِ يَمْنَعُهُ مِنَ ابْنِ السَّبِيلِ، وَرَجُلٌ بَايَعَ إِمَامًا لَا يُبَايِعُهُ إِلَّا لِدُنْيَا، فَإِنْ أَعْطَاهُ مِنْهَا وَفَى لَهُ، وَإِنْ لَمْ يُعْطِهِ مِنْهَا لَمْ يَفِ لَهُ، وَرَجُلٌ بَايَعَ رَجُلًا بِسِلْعَةٍ بَعْدَ الْعَصْرِ، فَحَلَفَ لَهُ بِاللَّهِ لَقَدْ أُعْطِيَ بِهَا كَذَا وَكَذَا، فَصَدَّقَهُ فَأَخَذَهَا


Allah's Apostle (SAW) said, "There are three persons whom Allah will neither talk to nor look at, nor purify from (the sins), and they will have a painful punishment. (They are): (1) A man possessed superfluous water on a way and he withheld it from the travelers. (2) a man who gives a Baia (pledge of allegiance) to a Muslim ruler and gives it only for worldly gains. If the ruler gives him what he wants, he remains obedient to it, otherwise he does not abide by it, and (3) a man bargains with another man after the Asr prayer and the latter takes a false oath in the Name of Allah claiming that he has been offered so much for the thing and the former (believes him and) buys it."


📖  Sahih al-Bukhari, Hadith No. 7212


Narrated/Authority of Ibn Masud


عَنْ عَبْدِ اللَّهِ بْنِ مَسْعُودٍ رضي الله عنه، قَالَ: قَالَ النَّبِيُّ ﷺ


مَنْ حَلَفَ عَلَى يَمِينٍ يَقْتَطِعُ بِهَا مَالَ امْرِئٍ مُسْلِمٍ، لَقِيَ اللَّهَ وَهُوَ عَلَيْهِ غَضْبَانُ


The Prophet (SAW) said, "Whoever takes a (false) oath in order to grab (others) property, then Allah will be angry with him when he will meet Him."

Narrated/Authority of Ibn Abu Aufa


عَنْ عَبْدِ اللَّهِ بْنِ أَبِي أَوْفَى رضي الله عنه


أَنَّ رَجُلًا أَقَامَ سِلْعَةً فِي السُّوقِ، فَحَلَفَ بِاللَّهِ لَقَدْ أُعْطِيَ بِهَا كَذَا وَكَذَا، وَلَمْ يُعْطَ بِهَا، فَنَزَلَتْ


إِنَّ الَّذِينَ يَشْتَرُونَ بِعَهْدِ اللَّهِ وَأَيْمَانِهِمْ ثَمَنًا قَلِيلًا أُولَٰئِكَ لَا خَلَاقَ لَهُمْ فِي الْآخِرَةِ وَلَا يُكَلِّمُهُمُ اللَّهُ وَلَا يَنْظُرُ إِلَيْهِمْ يَوْمَ الْقِيَامَةِ وَلَا يُزَكِّيهِمْ وَلَهُمْ عَذَابٌ أَلِيمٌ


[آل عمران: 77]


وَقَالَ ابْنُ أَبِي أَوْفَى: كَاذِبُ الْيَمِينِ غَادِرٌ، وَآكِلُ الرِّبَا غَادِرٌ


A man displayed some goods in the market and took a false oath that he had been offered so much for them though he was not offered that amount Then the following Divine Verse was revealed: "Verily! Those who purchase a little gain at the cost of Allah's covenant and their oaths . . . Will get painful punishment." (3.77) Ibn Abu Aufa added, "Such person as described above is a treacherous Riba-eater (i.e. eater of usury).



📖 Sahih Bukhari, Hadith No: 857


Narrated/Authority of Abdullah


عَنْ عَبْدِ اللَّهِ رضي الله عنه، قَالَ: قَالَ النَّبِيُّ ﷺ


«مَنْ كَانَ حَالِفًا فَلْيَحْلِفْ بِاللَّهِ أَوْ لِيَصْمُتْ»


The Prophet (SAW) said, "Whoever has to take an oath should swear by Allah or remain silent." (i.e. He should not swear by other than Allah.)


📖  Sahih al-Bukhari, Hadith No. 2679


Narrated/Authority of Abu Huraira


آيَةُ الْمُنَافِقِ ثَلَاثٌ: إِذَا وَعَدَ أَخْلَفَ، وَإِذَا حَدَّثَ كَذَبَ، وَإِذَا اؤْتُمِنَ خَان»


(There are three signs for a hypocrite: when he promises, he breaks his promise; when speaks, he lies; and when he is entrusted, he betrays.) 


📖  Sahih al-Bukhari, Hadith No. 33


And in another Hadith in the Sahih,


عَنْ عَبْدِ اللَّهِ بْنِ عَمْرٍو رضي الله عنهما، قَالَ: قَالَ رَسُولُ اللَّهِ ﷺ


«أَرْبَعٌ مَنْ كُنَّ فِيهِ كَانَ مُنَافِقًا خَالِصًا، وَمَنْ كَانَتْ فِيهِ خَصْلَةٌ مِنْهُنَّ كَانَتْ فِيهِ خَصْلَةٌ مِنَ النِّفَاقِ حَتَّى يَدَعَهَا: إِذَا اؤْتُمِنَ خَانَ، وَإِذَا حَدَّثَ كَذَبَ، وَإِذَا عَاهَدَ غَدَرَ، وَإِذَا خَاصَمَ فَجَرَ


The Prophet ﷺ said: “There are four characteristics, whoever has all four is a pure hypocrite; and whoever has one of them has one characteristic of hypocrisy until he gives it up: when he is entrusted, he betrays; when he speaks, he lies; when he makes a covenant, he acts treacherously; and when he quarrels, he behaves wickedly.”


📚 Sahih al-Bukhari, Hadith No. 34

 

Narrated Imran ibn Husayn:


عَنْ عِمْرَانَ بْنِ حُصَيْنٍ رضي الله عنه، قَالَ: قَالَ رَسُولُ اللَّهِ ﷺ


مَنْ حَلَفَ عَلَى يَمِينٍ كَاذِبَةٍ مُقْتَطِعًا بِهَا مَالَ امْرِئٍ مُسْلِمٍ، فَلْيَتَبَوَّأْ مَقْعَدَهُ مِنَ النَّارِ


 The Prophet (peace_be_upon_him) said: If anyone swears a false oath in confinement, he should make his seat in Hell on account of his (act). 


📖 : Sunan Abi Dawud, Hadith No. 3242

 

Narrated Jabir ibn Abdullah: 


عَنْ جَابِرِ بْنِ عَبْدِ اللَّهِ رضي الله عنهما، قَالَ: قَالَ رَسُولُ اللَّهِ ﷺ


لَا يَحْلِفْ أَحَدٌ عِنْدَ مِنْبَرِي هَذَا عَلَى يَمِينٍ آثِمَةٍ، وَلَوْ عَلَى سِوَاكٍ أَخْضَرَ، إِلَّا تَبَوَّأَ مَقْعَدَهُ مِنَ النَّارِ، أَوْ وَجَبَتْ لَهُ النَّارُ


The Prophet (peace_be_upon_him) said: One should not take a false oath at this pulpit of mine even on a green tooth-stick; otherwise he will make his abode in Hell, or Hell will be certain for him.

 Narrated AbuHurayrah:


عَنْ أَبِي هُرَيْرَةَ رضي الله عنه، قَالَ: قَالَ رَسُولُ اللَّهِ ﷺ


لَا تَحْلِفُوا بِآبَائِكُمْ، وَلَا بِأُمَّهَاتِكُمْ، وَلَا بِالْأَنْدَادِ، وَلَا تَحْلِفُوا إِلَّا بِاللَّهِ، وَلَا تَحْلِفُوا بِاللَّهِ إِلَّا وَأَنْتُمْ صَادِقُونَ


 The Prophet (peace_be_upon_him) said: Do not swear by your fathers, or by your mothers, or by rivals to Allah; and swear by Allah only, and swear by Allah only when you are speaking the truth. 


"Breaking an oath"



عَنْ عُقْبَةَ بْنِ عَامِرٍ رضي الله عنه، قَالَ: قَالَ رَسُولُ اللَّهِ ﷺ


«كَفَّارَةُ النَّذْرِ كَفَّارَةُ الْيَمِينِ»


📖 المرجع: صحيح مسلم، كتاب النذر، حديث رقم 1645


“The expiation of (the breach of) a vow is the same as the expiation of (the breach of) an oath.”  


📖 Sahih Muslim, Book of Vows (Kitab an-Nadhr), Hadith No. 1645


Allah the Almighty commands about the expiation of oaths in the Quran as follows:


لاَ يُؤَاخِذُكُمُ اللّهُ بِاللَّغْوِ فِي أَيْمَانِكُمْ وَلَـكِن يُؤَاخِذُكُم بِمَا عَقَّدتُّمُ الأَيْمَانَ فَكَفَّارَتُهُ إِطْعَامُ عَشَرَةِ مَسَاكِينَ مِنْ أَوْسَطِ مَا تُطْعِمُونَ أَهْلِيكُمْ أَوْ كِسْوَتُهُمْ أَوْ تَحْرِيرُ رَقَبَةٍ فَمَن لَّمْ يَجِدْ فَصِيَامُ ثَلاَثَةِ أَيَّامٍ ذَلِكَ كَفَّارَةُ أَيْمَانِكُمْ إِذَا حَلَفْتُمْ وَاحْفَظُواْ أَيْمَانَكُمْ كَذَلِكَ يُبَيِّنُ اللّهُ لَكُمْ آيَاتِهِ لَعَلَّكُمْ تَشْكُرُونَ


“God does not take you to task for the oaths you utter unintentionally, but He will certainly take you to task for the oaths you have sworn in serious intention. The expiation (for breaking such oaths) is the feeding of ten desperate persons with the average of what you feed to your own families, or to clothe them, or to set one subjugated person free from bondage. Who does not find the means, shall fast for three days. This is the expiation for your oaths whenever you have broken them. But do keep your oaths. Allah makes clear to you His commandments, so that you may fulfill your duties.” 


(Al-Maidah/The Feast 5:89)


To feed ten person means to give them all meals like breakfast, lunch and dinner. You can also feed one needy person for ten days.


Feeding or clothing should be the average of your daily expenses according to your social and economic situation. You can also cover the expenses of their meals & clothes rather than feeding and clothing them.


The Almighty Allah commands in another verse:


 وَلَا تَجْعَلُوا اللَّهَ عُرْضَةً لِّأَيْمَانِكُمْ أَن تَبَرُّوا وَتَتَّقُوا وَتُصْلِحُوا بَيْنَ النَّاسِ ۗ وَاللَّهُ سَمِيعٌ عَلِيمٌ (224)


“Do not use (the name of) God in an oath as an obstacle towards piety, mindfulness and reconciliation of people. God is all-listening, all-knowing.” 


(Al-Baqarah / The Cattle 2:224)


Your oath must not be an obstacle to doing good deeds. If you took an oath of this kind, you must break it immediately and expiate for it.



And Allah (سُبْحَانَهُ وَتَعَالَى) Knows Best.

STRAIGHTENING THE PRAYER ROWS: GUIDANCE FROM SHAYKH IBN BAAZ رحمه الله | AR-EN




 

 


حكم مباعدة القدمين أثناء صلاة الجماعة

 

السؤال

 

رسالة وصلت إلى البرنامج من أحد الإخوة المستمعين من جدة هو: محمد أحمد علي، أخونا محمد رسالته مطولة كثيرًا، ملخص ما فيها: أنه يشاهد بعض المصلين يتكلف في المباعدة بين القدمين أثناء الصلاة، ويرجو من سماحة الشيخ التوجيه؟

 

الجواب

 

السنة للمؤمن في هذا أن يقارب بين قدميه، ولا يؤذي جيرانه، وهكذا الآخر والآخر كلهم يتقاربون ويسدون الخلل بينهم والفرج، ولا يؤذي بعضهم بعضًا، فيكون قدماه في مكانهما المناسب، بحيث لا يؤذي من عن يمينه وشماله، وهكذا الآخر والآخر كل واحد يلصق قدمه بقدم صاحبه؛ حتى لا يكون بينهما فرج، ومن غير أذى، ولا محاكة، ولا أذى، هكذا

 

أما أن يفسح حتى يؤذي من حوله؛ فلا يجوز هذا، الواجب أنه يجر صاحبه إليه، والآخر يجر صاحبه إليه حتى يسدوا الفرج، ويتقاربوا من دون أن يؤذي بعضهم بعضًا، تكون مقاربة، يسد بها الخلل، ولكن ليس فيها إيذاء، ولا مضايقة للمصلي، كل واحد يلاحظ أخاه، ولا يضايقه، ولا يؤذيه، ولكن مع هذا يسدون الخلل، يتقاربون من غير حاجة إلى يفسح هذا ويفسح هذا، بل يتقاربون؛ حتى يسدوا الخلل بينهم، هذا هو المشروع، وهذا هو الواجب

Standing Position in Prayer

 

A person notes that they observe some worshippers going to great lengths to space their feet far apart during prayer, and they ask for guidance from the respected Sheikh.

 

The proper way (Sunnah) for a believer in this matter is to keep their feet close together without disturbing those praying nearby. Similarly, everyone should stand close together, filling any gaps between them without causing discomfort to one another. Each person should position their feet appropriately so as not to disturb those to their right and left. Everyone should place their foot next to their neighbor's foot to eliminate gaps, without causing disturbance or discomfort.

 

However, it is not permissible to spread out so much that it disturbs those around you. What is required is that each person draws closer to their neighbor, and the other does the same, in order to close the gaps and stand close together without causing mutual disturbance. The closeness should fill the gaps but without causing discomfort or inconvenience to other worshippers. Each person should be mindful of their brother and not crowd or disturb them, while still closing the gaps between them without needing to spread out excessively. This is what is prescribed and what is required.

 


 

 

سد خلل الصفوف من دون أذية للمصلي بجواره

 

 

ألاحظ أن بعض الناس إذا قام إلى الصلاة يبالغ في الفتحة ما بين رجليه حتى أنه يؤذي من بجانبه؟

 

 

الجواب

 

نعم ينبغي لكل مصلي ألا يؤذي جاره، وأن يحرص على سد الخلل من دون أذى، كل واحد يطلب من أخيه أن يقرب حتى يلزق قدمه بقدمه من دون محاكة ولا أذى، المقصود سد الخلل؛ فلا يفجح ويباعد بين رجليه ويؤذي جيرانه، ولا يمتنع الجيران من القرب منه، بل كل واحد يقرب من أخيه ويسد الخلل، كما أمر بهذا النبي -عليه الصلاة والسلام- فإنه قال: سدوا الفرج وقال أنس  كان أحدنا يلصق قدمه بقدم صاحبه


فينبغي لك يا عبدالله! أن تلاحظ سد الخلل، وسد الفرج من دون أن تؤذي جيرانك بالفجح، وهو كذلك جاره، وهكذا جارك يحرص على أن يستقيم في وقفته، وفي موضع قدميه؛ حتى يحصل سد الخلل من دون أذى، من كل واحد لجاره

FORMING THE LINES WITHOUT HARMING OTHERS 

 

I notice that some people, when they stand for prayer, exaggerate the gap between their feet to the point of causing discomfort to those beside them.

 

Every person praying should avoid harming their neighbor and should be careful to close the gaps without causing harm. Each one should ask their brother to come closer until their foot touches the other's foot without mimicry or harm. The purpose is to close the gaps. Some spread their legs wide and harm those next to them, and the neighbors should not refrain from getting closer to him. Rather, each person should get closer to their brother and close the gaps as instructed by the Prophet, peace be upon him, who said: "Close the gaps."

 

Anas, may Allah be pleased with him, said:

 

"Each of us would align his foot with the foot of his companion."

 

Therefore, O servant of Allah, you should mind closing the gaps without harming your neighbors by spreading too wide. Likewise, your neighbor should strive to stand properly and position his feet correctly so that gaps are closed without anyone causing harm to their neighbor.

 

 

 

 

هل التراص في الصفوف يلزم منه ملامسة الأقدام؟

 

 

السؤال

السائل أخوكم عبد الله من الرياض يقول في هذا السؤال: سؤالي: سمعت أنه في الصلاة يجب على المصلين في الصف الواحد أن تكون قدم كل واحد منهم ملامسة للآخر ومن يصلي بجانبه في الصف، فهل ورد في ذلك شيء سماحة الشيخ؟

 

 

الجواب

 

ورد نعم عن النبي ﷺ أنه أمر برص الصفوف، أمر الصحابة أن يتراصوا في الصف وأن يسدوا الفرج، وكان بعض الصحابة يلزق قدمه من قدم صاحبه حتى لا تقع فرجة، لكن ما فيه المحاكة والإيذاء، يكون قريبًا منه حتى لا تكون فرجة، فالسنة أن يكون الصف متراصًا ليس فيه فرج هذا السنة

 

أما كونه يحاك قدم أخيه ما هو لازم المهم أن يسد الفرجة؛ لأن بعض الناس ما يتحمل هذا الحك ما يتحمل كونه يلمس رجله، فتكون حولها من دون محاكة من دون أذى لكن ما فيه فرجة. نعم

Is physical foot-to-foot contact required when straightening the prayer rows ?

 


Question:

 

The questioner, your brother Abdullah from Riyadh, says:

 

"I heard that in prayer, worshippers standing in a row must have their feet touching the feet of those next to them. Is there any evidence for this, dear Shaykh?"

 

🎧 Answer:

 

Yes, it has been reported from the Prophet ﷺ that he commanded the alignment of rows, and instructed the Companions to close the gaps. Some of the Companions would even place their feet next to their neighbor’s foot so that no gap would occur.

 

However, there should be no excessive friction or harm. The person should be close enough to the one beside him to ensure there are no gaps, and this is the Sunnah.

 

As for rubbing or pressing one's foot against the other's — that is not required. The important thing is to close the gap. Some people do not tolerate such friction and do not like their feet being touched, so one may be close without touching, avoiding harm, but ensuring no gaps remain.

السؤال س: من المعلوم أنه ورد عن النبي صلى الله عليه وسلم عدة أحاديث في تسوية الصفوف ورصها، وبعض المصلين يلصق القدم بالقدم، فهل ورد عن النبي صلى الله عليه وسلم ما يدل على شرعية ذلك؟

 

الاجابـــة

 

ورد فيه حديث عن النعمان رضي الله عنه وغيره يقول: “حتى رأينا يلصق أحدنا كعبه بكعب صاحبه ومنكبه بمنكبه “، والعلماء قالوا المراد بذلك

 

المبالغة في ترك الفرج والتراص في الصفوف، وعدم تخليه فرج بينها، وليس المراد الاحتكاك، فإن في ذلك شيء من المضايقات، وبعض الناس يتأثر بمماسة غيره له، فالمصلي مأمور أن يرص أخاه أي يقترب منه، ولا يترك بينه وبينه فرجه، ولكن لا تلزم المماسة لبشرة الكعب للكعب الثاني، وبعض الناس يحرص على تحقيق ذلك، فتراه يفرق بين قديمه، حتى يجعل بين قدميه ذراعًا أو أكثر، حتى تلتصق قدماه بمن عن يمينه وبمن عن يساره، وهذا فيه شيء من الضرر على نفسه، وعلى غيره، فالأولى عدم الإضرار، والاقتصار على التقارب دون مماسة. والله أعلم

**Subject of the Fatwa**: The ruling on physical contact when Straightning rows in prayer

 

 

**Question**:


 It is known that several hadiths have been reported from the Prophet, peace be upon him, regarding straightening and arranging the prayer rows. Some worshippers press their feet against the feet of others. Is there evidence from the Prophet, peace be upon him, indicating the legitimacy of this practice?

 

**Answer**:

 

There is a hadith reported from Al-Nu'man, may Allah be pleased with him, and others, saying:

 

"Until we saw one of us pressing his heel against the heel of his companion and his shoulder against his companion's shoulder."

 

Scholars have stated that the intent of this is to emphasize leaving no gaps and maintaining compact rows, not physical contact itself, as this can cause discomfort. Some people are bothered by others touching them during prayer.

 

The worshipper is instructed to stand close to his brother, meaning to be near him without leaving a gap, but physical contact between heels is not required. Some people are keen on achieving this contact, so they spread their feet wide apart, placing their feet as much as a forearm's length or more, so that their feet touch those on their right and left. This causes some harm to themselves and others. It is preferable to avoid causing harm and to be content with proximity without physical contact.

الشيخ: ايش أنه ايش؟

 

السؤال: يعني لم يقل بتوحيد الصيام ورؤية الهلال في رمضان؟

 

الجواب

 

الشيخ: نعم. شيخ الإسلام رحمه الله يرى أنه متى رؤي الهلال وجب الصوم، ومتى رؤي هلال شوال وجب الفطر سواء رؤي في الأماكن الأخرى أم لم يرى، ولا يلزم الأماكن الأخرى إذا كانت تخالف البلد، بلد الرؤية في مطالع الهلال لا يلزمهم أن يصوموا إن كان الهلال هلال رمضان، ولا أن يفطروا إن كان الهلال هلال شوال، فهو يقول رحمه الله: مطالع الهلال تختلف باتفاق أهل المعرفة بذلك، فإن اتفقت المطالع وجب اتفاق الجميع، وإن لم تتفق وجب لكل بلدٍ حكمه، وما قاله رحمه الله هو الصواب

May Allah reward you with goodness. A questioner asks: *O noble Shaykh, I heard that Shaykh al-Islam Ibn Taymiyyah (may Allah have mercy on him) prohibited, in his book "Al-Fatawa," unifying the fasting and the sighting of the crescent moon for Ramadan. Is this correct? *

 

**Shaykh (Ibn 'Uthaymeen):** What did he say?

 

**Questioner: ** Meaning, he did not advocate unifying the fasting and the sighting of the crescent moon for Ramadan?

 

**Answer: **

 

Yes. Shaykh al-Islam (may Allah have mercy on him) held the view that whenever the crescent moon is sighted, fasting becomes obligatory, and whenever the Shawwal crescent is sighted, breaking the fast becomes obligatory—regardless of whether it was sighted in other regions or not. Other regions are not obligated (to follow) if their moon sighting differs from that of the initial location due to differing moon visibility horizons (*matāli‘ al-hilāl*).

 

He (may Allah have mercy on him) said: *"The visibility horizons of the crescent moon differ by the consensus of those knowledgeable in this matter. If the horizons align, then all must follow the same ruling. If they differ, then each region follows its own ruling."*

 

What he (may Allah have mercy on him) said is the correct opinion.

السؤال

 

 

اختلاف البلدان في الصيام، فنجد مثلاً أن هذا البلد ما زالت تصوم، والأخرى عندهم نفس اليوم عيد، فما حكم ذلك؟

 

الجواب

 

 

الشيخ: حكم هذا أن هذه المسألة اختلف فيها أهل العلم، هل يثبت دخول الشهر إذا ثبت في بلد؟ هل يثبت حكمه في جميع البلاد الإسلامية، أو يختص الحكم في هذا البلد، أو يختص الحكم بهذا البلد وبما وافقها في مطالع الهلال؟ في هذا خلاف بين أهل العلم على نحو ستة أقوال في هذه المسألة: فمنهم من قال: إنه قد ثبت ثبوتاً لا شك فيه أن مطالع الهلال تختلف، فإذا كانت تختلف فإن الواجب أن يكون حكم دخول الشهر أو خروجه مربوطاً باختلاف المطالع، فإن اتفقت المطالع بين البلدان فإنه يثبت في هذه البلدان حكم دخول الشهر إذا ثبتت رؤية في بلد واحد منها، وإذا اختلفت المطالع فإن لكل بلد حكمها، وهذا اختيار شيخ الإسلام ابن تيمية رحمه الله، والذي تدل عليه النصوص؛ فمن ذلك قوله تعالى:


فَمَنْ شَهِدَ مِنْكُمُ الشَّهْرَ فَلْيَصُمْهُ

 

والذين تختلف مطالعهم عن بلد الرؤية لم يكونوا شهدوا الشهر، وقال النبي صلى الله عليه وسلم: «إذا رأيتموه فصوموا، وإذا رأيتموه فأفطروا». والذين تختلف مطالع الهلال بينهم لم يكونوا يروها، والنبي عليه الصلاة والسلام علق الحكم على الرؤية، وكما أن هذا مقتضى دلالة الكتاب والسنة فهو بمقتضى القياس أيضاً؛ فإن الناس يختلفون في الحكم في طلوع الشمس وغروبها، فتجد بلداً قد طلع عليه الفجر فأمسكوا عن الصيام، والبلد الآخر ما يزالون يأكلون ويشربون، وتجد بلداً قد غربت الشمس عندهم، فحل لهم الأكل والشرب، وبلداً آخر لم تغب الشمس عندهم، فهم ما زالوا صائمين، وإذا كانت البلاد تختلف باختلاف طلوع الشمس وغروبها، وهو توقيت يومي، فكذلك يجب أن تختلف البلاد باختلاف منازل القمر ومطالعه، وهذا توقيت شهري، ولكن العمل اليوم العمل على أحد الأقوال الستة التي أشرت إليها، وهي أن الحكم يتعلق بالعمل أي بالسلطة، فإذا كانت هذه البلاد تحت سلطة واحدة فإنه يثبت حكم الهلال في حقها جميعاً ولو تباعدت، ويرى بعض العلماء أنه متى ثبت الرؤية ثبت الهلال في أي بلاد إسلامي، فالحكم لجميع الأمة الإسلامية

**Differences Among Muslims Regarding Fasting and Breaking the Fast**

 

 

**Question: **

 

There are differences among countries concerning fasting. For example, one country may still be fasting while another is celebrating Eid on the same day. What is the ruling on this?

 

 

**Answer: **

 

The ruling on this matter is that scholars have differed on whether the beginning of the month (of Ramadan or Shawwal) is established for all Muslim countries if it is confirmed in one country, or if the ruling applies only to that country or to regions sharing the same moon sighting. There are about six opinions on this issue among scholars.

 

 

Some scholars argue that it is an established fact that moon sightings differ based on geographical locations. Therefore, the ruling on the beginning or end of the month should be linked to these differences in sightings. If regions share the same moon sighting, then the sighting in one country applies to all of them. However, if their sightings differ, each region should follow its own sighting. This is the view favored by Sheikh al-Islam Ibn Taymiyyah (may Allah have mercy on him), and it is supported by textual evidence.

 

Allah says:

 

**"So, whoever sights [the crescent of] the month, let him fast it."** (Quran 2:185)

 

Those whose moon sighting differs from the country where it was sighted did not actually "see" the moon.

 

The Prophet (peace be upon him) said:

 

**"Fast when you see it (the crescent), and break your fast when you see it."**

 

Those in regions with different moon sightings did not see it, and the Prophet (peace be upon him) tied the ruling to actual sighting.

 

This understanding is also supported by analogy (Qiyas). People differ in rulings based on sunrise and sunset—some begin fasting at dawn while others are still eating, and some break their fast at sunset while others continue fasting. If daily timings differ based on location, then monthly timings (based on moon phases) should also differ.

 

However, the current practice follows one of the six opinions mentioned—that the ruling depends on the governing authority. If countries are under one authority, the sighting applies to all, even if they are far apart. Some scholars hold that once the moon is sighted in any Muslim country, it applies to the entire Muslim Ummah.

اختلاف الرؤية في دخول شهر رمضان

 


السؤال

 


رسالة وصلت من مجموعة من الإخوة السائلين من السودان والعراق واليمن، يقول في السؤال: هناك من يصوم رمضان برؤية الهلال بالمملكة العربية السعودية، ومنهم من يصوم تبعاً للدولة التي يسكن فيها مما يسبب بعض الاختلافات في تحديد دخول رمضان، فكيف يكون التصرف، جزاكم الله عنا وعن المسلمين خير الجزاء؟

 

الجواب

 

الشيخ: الحمد لله رب العالمين، وأصلي وأسلم على نبينا محمد، وعلى آله وأصحابه أجمعين

 

هذه المسألة أعني مسألة الهلال مختلف فيها بين أهل العلم، فمنهم من يرى أنه إذا ثبت رؤية الهلال على وجه شرعي فإنه يلزم الجميع المسلمين الصوم إن كان هلال رمضان، والفطر إن كان هلال شوال، وهذا هو المشروع من مذهب الإمام أحمد، وعلى هذا فإن رؤي في المملكة العربية السعودية وجب على جميع المسلمين في كل الأقطار أن يعملوا بهذه الرؤيا صوماً في رمضان، وفطراً في شوال، وهذا هو المشهور في مذهب الإمام أحمد رحمه الله، واستدلوا لذلك بعموم قوله تعالى: «فمن شهد منكم الشهر فليصمه»، وعموم قول الرسول صلى الله عليه وسلم: «إذا رأيتموه فصوموا وإذا رأيتموه فأفطروا»، قالوا: والخطاب للمسلمين فيشمل جميع المسلمين في جميع أقطار الأرض

 

ومن العلماء من يقول: إنه لا يجب الصوم في هلال رمضان ولا الفطر في شوال إلا لمن رأى الهلال أو كان موافقاً فيمن رآه في مطالع الهلال؛ لأن مطالع الهلال تختلف باتفاق أهل المعرفة في ذلك، فإذا اختلفت وجب أن يحكم لكل بلد برؤيته، والبلاد الأخرى موافقة في مطالع الهلال فلا تبع له وإلا فلا، وهذا القول اختيار شيخ الاسلام ابن تيمية رحمه الله، واستدل بهذا القول بقوله تعالى: ﴿فمن شهد منكم الشهر فليصمه﴾، وكقول النبي صلى الله عليه وسلم: «إذا رأيتموه فصموا وإذا رأيتموه فأفطروا»، أي بنص الدليل الذي استدل به من يرى عموم وجوب الصوم على كل أحد إذا ثبتت رؤيته في مكان من بلاد المسلمين، لكن الاستدلال يختلف وجه الاستدلال أن شيخ الإسلام بن تيمية في هذه الآية والحديث؛ لأن الحكم علق بالشاهد والرأي وهذا يقتضي أن من لم يشهد ولم يرى لم يلزمه الحكم بذلك، وعليه فإذا اختلفت المطالع فإن البلاد المخالفة لبلاد الرؤية لا يكون قد شوهد فيها الهلال ولا رؤي، وحينئذ لا تكون تثبت أحكام الهلال في حقهم وهذا لاشك وجه قوي في الاستدلال وأقوى من الأول، ويؤيده النظر والقياس، فإنه إذا كان الشارع قد علق الإمساك للصائم بطلوع الفجر، والفطر بغروب الشمس فقال تعالى: ﴿فكلوا وأشربوا﴾، فقال تعالى: ﴿فَالْآنَ بَاشِرُوهُنَّ وَابْتَغُوا مَا كَتَبَ اللَّهُ لَكُمْ وَكُلُوا وَاشْرَبُوا حَتَّى يَتَبَيَّنَ لَكُمُ الْخَيْطُ الْأَبْيَضُ مِنَ الْخَيْطِ الْأَسْوَدِ مِنَ الْفَجْرِ ثُمَّ أَتِمُّوا الصِّيَامَ إِلَى اللَّيْل﴾، فالشارع علق الحكم بتبين طلوع الفجر إمساكاً، وبالليل إفطاراً، والنبي عليه الصلاة والسلام قال: «كلوا واشربوا حتى تسمعوا أذان ابن أم مكتوم، فإنه لا يؤذن حتى يطلع الفجر»، وقال: «إذا أقبل الليل من هاهنا وأشار المشرق وأدبر النهار من هاهنا، وأشار إلى المغرب، وغربت الشمس فقد أفطر الصائم»، والمعلوم بإجماع المسلمين أن هذا الحكم ليس عاماً في جميع البلدان، بل هو خاص في كل بلد يثبت فيه هذا الأمر، تجد الناس في الشرق يمسكون قبل الناس في الغرب ويفطرون قبلهم حسب تبين الفجر وغروب الشمس، فإذا كان توقيت اليومي متعلق بكل بلد بحسبه فهكذا التوقيت الشهري يتعلق بكل بلد بحسبه، وبهذا يتبين أن القول الذي اختاره شيخ الإسلام بن تيمية رحمه الله هو القول الراجح أثراً ونظراً، هناك قول ثالث: أن الناس يتبعون إمامهم فإذا قرر الإمام وهو ذا السلطة العليا في البلد دخول الهلال وكان ذلك بمقتضى الأدلة الشرعية وجب العمل بمقتضى هذا الهلال صوماً في رمضان، وإفطاراً في شوال، وإذا لم يقرر ذلك فإنه لا صوم ولا فطر، واستدل لهذا القول بقول النبي صلى الله عليه وسلم: «الفطر يوم يفطر الناس والأضحى يوم يضحي الناس»، وهذا هو الذي عليه العمل في وقتنا الحاضر، ولهذا فنقول للسائل: الأولى أن لا تخالف الناس، بل بعبارة أصح بل ألا تظهر مخالفة الناس، فإذا كنت ترى أنه يجب العمل بالقول الأول وأنه إذا ثبت رؤية الهلال في مكان من بلاد المسلمين على وجه شرعي وجب العمل بمقتضى ذلك، وكان في ذلك لم تعمل بهذا، وترى أحد الرأيين الآخرين فإنه لا ينبغي لك أن تظهر المخالفة لما في ذلك من الفتنة والفوضى والأخذ والرد، وبإمكانك أن تصوم سراً في هلال رمضان، وأن تفطر سراً في هلال شوال، أما المخالفة فهذه لا تنبغي وليست مما يأمر به الإسلام. نعم

**Difference in Sightings for the Beginning of Ramadan**

 

 

**Question: **

 

A message was received from a group of brothers asking from Sudan, Iraq, and Yemen. The question states: Some people fast Ramadan based on the sighting of the crescent moon in the Kingdom of Saudi Arabia, while others fast according to the country they reside in, leading to some differences in determining the start of Ramadan. How should one act in this situation? May Allah reward you with the best for us and all Muslims.

 

 

**Answer: **

 

 

**Shaykh: ** Praise be to Allah, the Lord of the worlds, and may peace and blessings be upon our Prophet Muhammad, his family, and all his companions.

 

 

This issue—the matter of the crescent moon—is one in which scholars have differed. Some hold the view that if the sighting of the crescent is confirmed in a valid Islamic manner, it becomes obligatory for all Muslims to fast if it is the crescent of Ramadan and to break the fast if it is the crescent of Shawwal. This is the well-known position in the school of Imam Ahmad (may Allah have mercy on him). According to this view, if the crescent is sighted in the Kingdom of Saudi Arabia, it becomes obligatory for all Muslims in all regions to act upon this sighting—fasting for Ramadan and breaking the fast for Shawwal.

 

Proponents of this view base their argument on the general meaning of Allah’s verse:

 

 

**"So whoever sights [the crescent of] the month, let him fast it."** (Quran 2:185)

 

 

And the general wording of the Prophet’s (peace be upon him) hadith:

 

**"When you see it (the crescent), fast, and when you see it, break your fast."**

 

They argue that this address is directed to all Muslims, encompassing every Muslim in every part of the world.

 

Other scholars hold the view that fasting for Ramadan or breaking the fast for Shawwal is only obligatory for those who have sighted the crescent or are in regions sharing the same moon visibility (matāli‘). This is because the visibility of the crescent differs, as agreed upon by experts in this field. Therefore, if the visibility differs, each region should act according to its own sighting. Regions sharing the same visibility should follow the sighting, while others should not.

 

This opinion was favored by Shaykh al-Islam Ibn Taymiyyah (may Allah have mercy on him). He supported this view with the same Quranic verse and hadith but interpreted them differently. He argued that the ruling is tied to witnessing or sighting, meaning that those who have not witnessed or seen the crescent are not obligated to act upon it. Thus, if visibility differs, regions that do not share the same visibility are not bound by the sighting in another region.

 

This reasoning is strong and is further supported by analogy (qiyās). Just as the Legislator has tied fasting to the appearance of dawn and breaking the fast to sunset—as in the verse:

 

**"Eat and drink until the white thread of dawn becomes distinct to you from the black thread [of night]."** (Quran 2:187)

 

—and the Prophet (peace be upon him) said:

 

**"Eat and drink until you hear the call to prayer by Ibn Umm Maktūm, for he does not call until Fajr has risen."**

 

Similarly, he said:

 

**"When night approaches from here (east) and day retreats from here (west), and the sun has set, the fasting person may break their fast."**

 

It is unanimously agreed among Muslims that this ruling is not universal but specific to each region based on its own timing. People in the east begin fasting before those in the west and break their fast earlier, depending on the appearance of dawn and sunset.

 

Thus, just as daily timings are region-specific, monthly timings (like the sighting of the crescent) should also be region-specific. This makes the opinion chosen by Ibn Taymiyyah the most sound in terms of both textual evidence and logical reasoning.

 

There is a third opinion: that people should follow their local Islamic authority. If the ruler (or governing body) of a country officially declares the beginning of the month based on valid Islamic evidence, then it becomes obligatory to act upon it—fasting for Ramadan and breaking the fast for Shawwal. If no such declaration is made, then neither fasting nor breaking the fast is required.

 

This opinion is supported by the hadith:

 

**"Eid al-Fitr is the day when people break their fast, and Eid al-Adha is the day when people sacrifice."**

 

This is the practice followed in our time today.

 

Therefore, my advice to the questioner is: It is best not to openly oppose the people (i.e., the local community). If you personally hold the first opinion—that if the crescent is sighted in any Muslim country in a valid manner, it becomes obligatory for all—but your country follows one of the other opinions, then you should not openly go against the people, as this could lead to fitnah (discord), chaos, and unnecessary disputes.

 

Instead, you may fast secretly if you believe Ramadan has begun, and break your fast secretly if you believe Shawwal has begun. However, openly opposing the community is not advisable and is not something Islam encourages.

حسين محمود أردني يدرس الطب في كراتشي بالباكستان يقول: ما حكم الاختلاف في رؤية هلال رمضان أو هلال شوال بين بلدان المسلمين؟ وكيف يفعل المسلم إذا حصل اختلاف قد يصل إلى يومين بزيادة أو نقص؟ فمن بدأ الصيام مثلاً في بلد متأخر بيومين ثم صادف في نهاية الشهر أن سافر إلى بلد آخر كان متقدماً في الصيام، وعلى هذا فسيكون العيد عندهم مبكراً، فماذا يفعل هذا القادم؟ وما الحكم إن كان الفرق أيضاً في رؤية هلال ذي حجة؟ فيكف يكون الحكم والعمل بالنسبة ليوم عرفة وما قبله وما بعده؟

الشيخ: هذا المسألة اختلف فيها أهل العلم، فمنهم من يرى توحيد المسلمين تحت رؤية واحدة بمعنى أنه إذا ثبت رؤية الهلال بمكان من بلاد المسلمين ثبت حكمه في جميع بلاد الإسلام شرقيها وغربيها، فإذا رأوا يعني مثلاً في المملكة العربية السعودية وجب على جميع المسلمين في جميع أقطاب الدنيا أن يعملوا بتلك الرؤيا صوماً وإفطاراً

 

ومنهم من يرى أن الحكم يختلف باختلاف العمل، يعني باختلاف الولايات، فإذا ثبت في مكان في ولاية واحدة ولو تباعدت أقطارها فإنه يجب العمل به في جميع تلك الولاية أو تلك الدولة دون بقية الدول الأخرى

 

ومنهم من يرى أن المعتبر في ذلك مطالع الهلال، فإذا اختلفت مطالع الهلال فإنه لا يلزم الاتفاق في الحكم، أما إذا اتفقت المطالع فإنه يلزم الاتفاق في الحكم، فإذا رؤي في بلد ما وكانت البلد الأخرى توافقها في مطالع القمر فإنه يلزمهم الصوم، وإن كانت تخالفها فإنه لا يلزمها. وهذا هو القول الراجح من حيث الدليل ومن حيث التعليل، أما الدليل فإن الله تعالى يقول: ﴿فمن شهد منكم الشهر فليصمه﴾ يعني من لم يشهد فلا يلزم عليه الصوم

 

ويقول النبي عليه الصلاة والسلام: وإذا رأيتموه فصوموا، وإذا رأيتموه فأفطروا. فمفهوم هذه الجملة الشرطية أننا إذا لم نره لا يلزمنا صوم ولا فطر. والمعنى والقياس يقتضيه، فإنه كما اختلفنا في الإمساك والإفطار اليومي كذلك يجب أن يكون خلاف في الإمساك والإفطار الشهري، ففي اليوم تغرب الشمس على أهل المشرق قبل غروبها على أهل المغرب، ومع ذلك فإن أهل المشرق يفطرون وأهل المغرب صائمون، وكذلك أهل المشرق يمسكون قبل أهل المغرب فيكون أهل المشرق قد أمسكوا لطوع الفجر عندهم وأهل المغرب يأكلون ويشربون لعدم طلوع الفجر عندهم. فإذا كان هذا الاختلاف ثابتاً بالإجماع في الإمساك والإفطار اليومي فمثله بلا شك الإفطار والإمساك الشهري؛ إذ لا فرق، ولكن مع ذلك نقول: إن الرجل إذا كان في مكان فإنه يتبع ذلك المكان إذا أمر ولاة الأمور بالصوم فليصم، وإذا أمروا بالإفطار فليفطر. فإذا قدم إلي بلد قد سبق برؤية الهلال؛ يعني بمعنى أنه قدم من بلد كانوا قد صاموا قبل هذا البلد الذي قدم إليه بيومين فإنه يبقى حتى يفطر أهل البلد الذي قدم إليهم، وإذ كان الأمر بالعكس بأن قدم من بلاد قد تأخروا في الصوم إلى بلاد قد تقدموا فإنه يفطر مع أهل هذه البلاد ويقضي ما بقي عليه من أيام الشهر؛ لأنه لا ينبغي للإنسان أن يخالف الجماعة، بل يوافقهم، وإذا بقي عليه شيء أتى به كالصلاة مثلاً يدرك الإمام في أثناء الصلاة فيصلي معه ما أدرك ويقضي ما فاته

 

والحاصل أن هذا هو حكم هذه المسألة أن العلماء اختلفوا فيها، ولكن وعلى كل حال فإذا كنت في بلد فصم معهم وأفطر معهم. أما بالنسبة لرؤية هلال ذي الحجة فإن المعتبر بلا شك البلد التي فيها إقامة المناسك، فإذا ثبت الهلال فيها عمل به ولا عبرة ببقية البلدان، وذلك بأن الحج مخصوص بمكان معين لا يتعداه، فمتى ثبت رؤية ذي الحجة في ذلك المكان وما ينسب إليه فإنه يثبت الحكم حتى لو خالفه بقية الأقطار

 

السؤال: بالنسبة للحالة الأولى التي هي في رمضان، ذهب إلى بلد وقد سبق به الصيام أيام، فمعنى هذا أنه لو استمر معهم -مع هذا البلد المتأخر- قد يكون صام يوم عيد في بلده الذي أنشأ فيه الصيام، هذا لا يؤثر؟

 

الشيخ: هذا لا يؤثر؛ إذ إنه أدرك في مكانه في وقت وجوب الفطر

 

السؤال: إذن العبرة بالعيد في نفس المكان الذي فيه؟

 

الشيخ: أي نعم، في نفس المكان الذي فيه. ولهذا قلنا لو قدم من بلد متأخر فإنه يفطر مع هؤلاء ويقضي ما فاته

The difference in sighting and the ruling for someone who travels from a place where the crescent moon is sighted to a place where it is not sighted

 

 

**Question: **

 

Hussein Mahmoud, a Jordanian studying medicine in Karachi, Pakistan, asks: What is the ruling on the difference in sighting the crescent moon for Ramadan or Shawwal among Muslim countries? And what should a Muslim do if the difference extends up to two days (more or less)? For example, if someone began fasting in a country that started two days later and then, at the end of the month, traveled to another country where they had started fasting earlier—meaning Eid would be earlier for them—what should this traveler do? Additionally, what is the ruling if the difference occurs in the sighting of Dhul-Hijjah’s crescent? How should one act regarding the day of Arafah and the days before and after it?

 

**Answer: **

 

This issue has been a matter of disagreement among scholars. Some scholars hold the view that Muslims should unify under a single sighting, meaning if the crescent moon is sighted in one Muslim country, its ruling applies to all Muslim lands, east and west. For example, if the moon is sighted in Saudi Arabia, all Muslims worldwide must act upon that sighting, whether for fasting or breaking the fast.

 

Others argue that the ruling varies based on different jurisdictions. If the sighting is confirmed in one region or country, even if its territories are far apart, the ruling applies only to that jurisdiction and not to others.

 

Yet another group believes that the criterion is the visibility of the crescent moon in different regions.

If the moon’s visibility differs between regions, the rulings need not align. However, if the visibility is the same, the ruling should be unified. This is the most correct opinion based on evidence and reasoning.

 

The evidence for this view comes from the Quranic verse:

 

**"So, whoever sights [the crescent of] the month, let him fast it."** (Quran 2:185)

 

This implies that those who do not witness the crescent are not obligated to fast. Similarly, the Prophet (peace be upon him) said:

 

**"When you see it (the crescent), fast, and when you see it, break your fast."**

 

The conditional phrasing indicates that if the moon is not sighted, neither fasting nor breaking the fast is obligatory.

 

This reasoning is also supported by analogy. Just as there are differences in daily fasting and breaking the fast (due to time zones), the same should apply to monthly fasting. For example, the sun sets earlier for people in the east than for those in the west, so they break their fast earlier while others are still fasting. Similarly, dawn arrives earlier for some than others. Since this difference is universally accepted in daily fasting, the same logic applies to the monthly fasting and Eid rulings.

 

However, if a person is in a particular country, they should follow its ruling. If the authorities declare fasting, they must fast, and if they declare Eid, they must break their fast.

 

**Practical Scenarios: **

 

1. **Traveling to a Country That Started Fasting Earlier: **

 

- If someone travels from a country that started fasting later to one that started earlier, they should break their fast with the people of that country and make up the remaining days later.

 

- This is similar to joining a prayer in progress—you pray with the congregation and complete what you missed afterward.

 

 

2. **Traveling to a Country That Started Fasting Later: **

 

- If someone travels from a country that started fasting earlier to one that started later, they should continue fasting until the people of that country celebrate Eid.

 

The key principle is that one should not go against the local community but rather align with them.

 

 

**Follow-up Question: **

 

In the first scenario (where someone travels to a country that started fasting earlier), if they continue fasting with the later-starting country, they might end up fasting on what is considered Eid day in their original country. Does this matter?

 

**Answer: **

 

No, it does not matter because they are now in a place where fasting is still obligatory. The ruling is based on the location they are in at the time.
